Terms of Service
Welcome to The Praiseloop. By creating an account or using our service, you agree to these Terms of Service. Please read them carefully.
1. Using the service
You must be at least 18 years old and capable of forming a binding contract to use The Praiseloop. You agree to use the service only for lawful purposes and in compliance with all applicable laws, including anti-spam and consumer protection laws governing the messages you send.
If you are a business and your agreement with us is a small business contract as defined in the Competition and Consumer Act 2010 (Cth), you acknowledge and agree that this is a standard form contract and that you have had the opportunity to seek independent legal advice before agreeing to these terms.
2. Your content
You retain ownership of all customer data and message content you upload. You grant The Praiseloop a limited license to process this data solely to provide the service to you.
3. Subscription and billing
Your paid plan automatically renews each month. You will be charged on the same day each month until you cancel. You can cancel anytime from your account settings. Paid plans renew automatically each month until cancelled.
4. Refunds
Your rights under the Australian Consumer Law: Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a refund or replacement for a major failure. If the failure is not major, we may choose to fix the problem within a reasonable time. We do not offer refunds for change of mind.
5. Acceptable use
You may not send messages to recipients who have not consented to receiving them. We may suspend accounts that generate excessive complaints or violate carrier guidelines.
From 1 July 2026, Australian law will require businesses that send branded SMS to register their Sender ID with the ACMA. We will assist our users to comply by providing guidance, but the obligation to register ultimately rests with the sender of the message.
6. Your Spam Compliance Obligations
You must: (a) obtain clear and informed consent from each recipient before sending any commercial electronic message through our service; (b) include a functional "unsubscribe" or "STOP" reply option in every message, as required by the Spam Act 2003; and (c) maintain records of consent for at least five years. You agree to indemnify (pay for any loss, damage, fine, or penalty incurred by) The Praiseloop against any non-compliance with spam laws or carrier guidelines.
7. Termination
We may suspend or terminate your account if you breach these terms. You may close your account at any time.
8. Disclaimer
The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, The Praiseloop is not liable for indirect or consequential damages, and our total liability is limited to the amount paid by you for the service in the preceding 12 months. You agree to indemnify The Praiseloop against any third-party claims arising from your use of the service.
10. Governing law
These Terms are governed by the laws of Victoria, Australia. You and we agree to submit to the non-exclusive jurisdiction of the courts of that state.
